TERMS AND CONDITIONS
1. Our Contract
Our online store invites you to buy goods from us by placing your order online at www.bidai.com.my. A legally binding contract with you will only arise once we have received payment for the goods in full from you (“the Payment”). We shall notify you of acceptance of your order by e-mail to the e-mail address given by you in the order form. We regret we cannot accept online orders from outside of peninsular Malaysia.
The Prices shown at our online stored does not includes the Goods and Services Tax (GST). Until further notice, we shall absorb the GST charges but we reserve our right to collect the GST charge in the future, All Prices shown at our online store are shown in Ringgit Malaysia.
3. Right to Cancel or Vary Your Order
3.1 You cannot cancel or change your order once your order has been confirmed and accepted by us. In order to achieve 7 working days of delivery (subject to the date given to us by the Delivery Company as mentioned in Clause 6 below), all orders will be custom made to your specification and requirements immediately after we received the orders. All goods sold are not refundable.
3.2.1 We reserve the right to cancel your order in the event the following occurs:-
(i) Insufficiency of stock; and/or
(ii) Typographical error and/or error in the pricing on the pricing information.
3.2.2 In the event the cancellation done pursuant to the above Clause 3.2.1, we shall do the following:-
(i) notify you by email; and
(ii) refund the payment made by credit to your account within twenty one (21) days from the date of notification
3.3.1 We reserve our right to vary your order in the event the following happened:-
(i) the Goods or the fabric you order are unavailable
(ii) [insert any event that you foresee you would want to vary, if any]
3.3.2 In the event the variation done pursuant to the above Clause 3.3.1, we shall do the following:-
(i) notify you by email on the variation; and
(ii) suggesting you the suitable replacement for your order
3.3.3 In the event you decided not to proceed with the replacement, you may cancel your order and we will re credit to your account any sum deducted by us from your credit card or Direct Debit in 21 working days of your notification of cancellation.
3.4 If you have more than (1) item in (1) order and we are unable to deliver all the items in 7 working days We shall split the delivery and notify you about the delayed items in 3 working days of your order. Should this delayed arise, we shall advice you the new delivery date for the delayed items. If you are not satisfied with the new delivery date you have the right to cancel your order and we will re credit to your account any sum deducted by us from your credit card or Direct Debit in 21 working days of your notification of cancellation.
3.5 If you have more than (1) item in (1) order and we are unable to deliver you few of the items due to insufficient stock or One or more of the goods was listed at the incorrect price due to typographical error or an error in the pricing information made by us and/or received by us we shall notify you in 3 working days of your order. Should this problem arise, both parties have the right to cancel the
unavailability stock order. You are not allowed to cancel the entire order. If we do cancel your unavailability stock order we will notify you by email and we will re credit to your account any sum deducted by us from your credit card or Direct Debit in 21 working days of our notification date. We will not be obliged to offer any additional compensation for disappointment suffered. If you cancel your unavailable stock order we will re credit to your account any sum deducted by us from your credit card or Direct Debit in 21 working days of your notification of cancellation.
4. Product Descriptions and Measurements
4.1 The product information and photographs contain within our online store are provided for illustrative purposes only and we cannot warrant that they are accurate. If you have any doubt as to the precise colour of the product or fabric you wish to order, you are advised to visit our showroom to view sample of the product.
4.2 As the goods you order is manufactured according to the measurements you provide in your order, it is very important that your measurements are accurate. We cannot accept any return of goods that manufactured according to your specification and measurement. You are advised to read the guide to measuring pages in our online store or contact us for any professional guidance pertaining to the measurement, installation, system as well as fabrics.
4.3 Every attempt will be made by us to ensure that the goods sold and delivered match in every respect any sample or description shown or given or sent to you, any minor or immaterial variation or change in colour or pattern between the sample or description and the goods delivered shall not entitle you to reject the goods nor to claim any compensation for such variation or change. Please be aware that if you are ordering custom made goods from measurements taken from a house plan, we cannot be held responsible if the measurements on the building plans vary, from the actual completed window measurement.
5. Delivering Your Goods
Bidai will deliver your goods to the address you have provided in the order form for delivery. We will immediately despatch the order upon completion. We will update your order status through email for you to retrieve your details ETA’s. Deliveries are Monday to Friday between 9am to 5pm. Bidai use third party freight delivery companies to deliver your orders and cannot be held responsible for any delays that may occur once the goods have left our premises. Whilst we shall use our reasonable endeavours to meet the delivery date specified on your order confirmation, we can only go by the date given to Us by the third party freight delivery companies.
6.1 Your personal information in our database will be safeguarded and will not be shared without your consent.
6.2 Your personal information may be disclosed to the following third parties for the purpose of us performing our services:-
(i) company and product research;
(ii) delivering packages;
(iii) sending mail/ emails; and
(iv) processing payments.
